Please read these Terms and Conditions ("Terms") carefully before using the PalStream application ("the App") available on iOS, iPadOS, macOS, and tvOS. By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using PalStream, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. Description of Service

PalStream is an IPTV media player application that allows users to organize and play media content from user-provided IPTV playlists (M3U, XMLTV, and Xtream format). The App provides:

• A media player interface for streaming live TV, movies, and series.
• Content organization features including search, favorites, and categories.
• Cross-device synchronization via iCloud.
• Optional third-party integrations (Trakt, OpenSubtitles).
• Parental control features.

PalStream does not provide, host, or distribute any media content. The App is a player and organizer for content sources that you supply.

3. User Responsibilities

3.1 Content Sources

You are solely responsible for the IPTV playlists and content sources you add to the App. You represent and warrant that:

• You have the legal right and authorization to access any content you stream through the App.
• Your use of content complies with all applicable local, national, and international laws and regulations.
• You have obtained any necessary subscriptions, licenses, or permissions required to access the content in your playlists.

3.2 Lawful Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App to access content you are not authorized to view.
• Use the App in any way that violates applicable laws or regulations.
• Attempt to reverse engineer, decompile, or disassemble the App.
• Modify, adapt, or create derivative works based on the App.
• Remove or alter any proprietary notices or labels on the App.
• Use the App to distribute or make available any unauthorized or pirated content.

3.3 Account Security

If you connect third-party accounts (such as Trakt) to the App, you are responsible for maintaining the security of those account credentials and for any activity that occurs through those connections.

4. Intellectual Property

4.1 App Ownership

The App, including its design, code, graphics, interface, and all associated intellectual property, is owned by PalStream and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted herein are reserved.

4.2 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple devices that you own or control, solely for your personal, non-commercial use.

4.3 Third-Party Content

Media content accessed through your playlists is owned by the respective content providers and rights holders. PalStream makes no claim of ownership over any media content you access through the App.

5. Third-Party Services

The App may integrate with third-party services including but not limited to:

• Trakt: For watch history tracking and synchronization.
• TMDB: For content metadata and imagery.
• OpenSubtitles: For subtitle search and download.
• Apple iCloud: For cross-device data synchronization.

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

6. Disclaimers

6.1 No Content Warranty

PalStream does not host, control, verify, or endorse any content accessed through user-provided playlists. We make no representations or warranties regarding the legality, quality, accuracy, or availability of any media content.

6.2 As-Is Basis

The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6.3 No Guarantee of Availability

We do not guarantee that the App will be available at all times, will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall PalStream, its developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, revenue, profits, or business opportunities.
• Damages arising from the use or inability to use the App.
• Damages arising from content accessed through user-provided playlists.
• Damages arising from unauthorized access to or alteration of your data.
• Damages arising from third-party service interruptions or failures.

Our total liability for any claims arising from or relating to these Terms or the use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless PalStream, its developers, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Content accessed through playlists you provide to the App.

9. Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for any reason, including but not limited to a violation of these Terms. Upon termination:

• Your license to use the App is immediately revoked.
• You must delete all copies of the App from your devices.
• Provisions of these Terms that by their nature should survive termination shall remain in effect.

10. App Store Terms

Your use of the App is also subject to the terms and conditions of the Apple App Store. In the event of any conflict between these Terms and the App Store terms, the App Store terms shall prevail to the extent of the conflict. Apple is not responsible for the App or its content.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised "Last updated" date. Your continued use of the App after any modifications constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Norway, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts of Norway.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PalStream regarding your use of the App and supersede any prior agreements.
